THE CONDITION OF THE JUDGMENT OF AHLULBAYT
(Peace be upon them)
AND THAT OF PROPHET DA'UD
(Peace be upon him)

There are attestations in many narrations about the government and the judgment of Prophet Da'ud (Peace be upon him) which shows that there is specialty in the judgment of that Prophet which doesn't need a witness. This narration is also expounding the condition of judgment of the pure Imams (Peace be upon them).

Be attentive and examine the following narration: 

«عن الساباطي قال: قلت لأبي عبد الله علیه السلام بما تحكمون إذا حكمتم؟

فقال: بحكم الله وحكم داود، فإذا ورد علينا شيء ليس عندنا تلقّانا به روح القدس..؟».

 

"From Sabati, he said: I said to the father of Abdullah (Peace be upon him): what is your formular when making judgment? He said: with Allah and Prophet Da'ud's judgment, when anything occurred to us that we didn't possessed its knowledge, the Holy One inspired on us"[1]

وهذه الرواية عن جعيد الهمداني  - وكان جعيد ممن خرج مع الحسين علیه السلام بكربلاء – «قال: قلت للحسين علیه السلام: جعلت فداك؛ بأيّ شيء تحكمون؟

قال: يا جعيد: نحكم بحكم آل داود، فإذا عيينا عن شيء تلقّانا به روح القدس».

Also examine the following narration: From Ju'aid al-Hamdani (Ju'aid is among those that rise up together with Imam Husain (Peace be upon him) in Karbala): I said to Imam Husayn (Peace be upon him): may my soul be sacrificed for you; with what did you judge? He said: O' Ju'aid; with the judgment of the family of Da'ud. At anytime we are lack of anything, the holy One inspired on us"[2]

This narration was also transmitted by late Allah Majlisi on the authority of Jua'id from Imam Sajjad (Peace be upon him).[3]

(Pointing at this is necessary, how the answers are connected with the valence of the general assembly that the narration was titled base on that, if not the holy spirit can be nursery child of the school of thought of Ahlulbayt (Peace be upon them);

كما صرح الإمام الحسن العسكري علیه السلام حين قال: «روح القدس في جنان الساقورة ذاق من حدائقنا الباكورة».

Just as Imam Hasan Askari (Peace be upon him) has clearly stated; the Holy Spirit learn knowledge from the garden of our intact ones).

وورد في رواية اخرى عن الإمام الصادق علیه السلام:

«عن حمران بن أعين قال: قلت لأبي عبد الله علیه السلام: أنبياء أنتم؟

قال: لا، قلت: فقد حدثني من لا أتّهم أنك قلت: إنكم أنبياء؟

قال: من هو أبو الخطاب؟

قال: قلت نعم.

قال: كنت إذاً أهجر؟ قال: قلت : بما تحكمون؟

قال: نحكم بحكم آل داود». 

It was narrated in another narration from Imam Sadiq (Peace be upon him): From Hamran bn A'yan: I said to the father of Abdullah (Peace be upon him): Are you a Prophet? He said: no, I said: I was informed by someone I cannot accuse that you a Prophet! He said: who is the person, is he Abu Khatab? Yes I replied.

Then I talk in vain? How did you make judgment? I inquired, he said: we judge with the judgment of the family of Da'ud.[4]

ويقول الإمام الباقر علیه السلام في رواية: «... أنّه إتّهم رجل زوجته بغيره فنقر رأسها وأراد أن يلاعنها عندي. فقال لها: بيني وبينك من يحكم بحكم داود وآل داود ويعرف منطق الطير ولا يحتاج إلى شهود. فأخبرته أنّ الذي ظنّ بها لم يكن كما ظنّ، فأنصرفا على صلح».

Imam Baqir (Peace be upon him) in another narration said:

"… A man accused his wife with another person and smashes her head, later he wanted to sworn allegation of committing adultery before the Imam. The husband said to her: who will judge like the judgment of Da'ud and the family of Da'ud between me and you, the one who knows the language of the birds and need not a witness. Then I (the Imam) informed him that your suspicion against her is not true therefore go on reconciliation with her"[5]

From this narration it was deduced that the pure Imams (Peace be upon them) are like Prophet Da'ud in judgment and never refer back to a witness. The pure Imams (Peace be upon them) sometimes also judge in such way. The honourable remainder of Allah's proof (May our souls be sacrifice for him) shall also judged base on his knowledge without the need for witness and oath.
