NARRATIVE DISCUSSION

Some people were of the belief that Prophet Da'ud's judgments base on reality without referring back to witness only occur in one or some occasions, but by studying this narrations we can deduce that the judgment of Prophet Da'ud is base on reality and not base on witness and that was not limited to one occasion because not only one thing causes discrepancy between individuals which necessitate their referring back to Prophet Da'ud.

In order to expound more on this issue be attentive to this narration.

ينقل عن الإمام الصادق علیه السلام أنّه قال: «إنّ داود علیه السلام قال : يا ربّ؛ أرني الحقّ كما هو عندك حتى أقضي به، فقال : إنك لا تطيق ذلك فالح على ربه حتى فعل، فجاءه رجل يستعدي على رجل فقال : إن هذا أخذ مالي فأوحى الله عزّ وجلّ إلى داود، إن هذا المستعدي قتل أبا هذا، وأخذ ماله فأمر داود بالمستعدي فقتل فأخذ ماله فدفعه إلى المعتدي عليه، قال : فعجب الناس وتحدثوا حتى بلغ داود علیه السلام ودخل عليه من ذلك ما كره، فدعا ربّه أن يرفع ذلك، ففعل ثمّ أوحى الله عزّ وجلّ إليه أن أحكم بينهم بالبيّنات وأضفهم إلى أسمي يحلفون به».

It was reported from Imam Sadiq (Peace be upon him) that he said: Prophet Da'ud (Peace be upon him) said to Almighty Allah: O' Allah let truth be apparent to me as it was before you, in order to enable me judge base on that.

Almighty Allah revealed to him saying: you don't possessed such ability! Prophet Da'ud insisted till his request is granted.

A man came to him seeking for assistance and after he has forward his complains against another man who has confiscated his wealth. Then Almighty Allah inspire on Prophet Da'ud that the person seeking for assistance has killed the other man's father and took the wealth from him.

Prophet Da'ud ordered the man seeking for assistance to be killed and the wealth to be returned to the other man. People were surprized of this incidence, thus they talked about it within themselves until it reaches the ears of Prophet Da'ud, and thus he intended to relinquish this act.

After then he requested from Almighty Allah to take away knowledge of realities from him, and Almighty Allah did so.

Later He inspired on him saying: Judge between people with witness including an oath with my name.[1]

This narration was transmitted by Allamah Majlisi from Mohammad bn Yahya; from Ahmad bn Mohammad; from Husayn bn Sayeed; from Fadalah bn Ayub; from Aban bn Uthman; from the person who gave him the information as you have seen the narration, Aban bn Uthman has transmitted the entire chain of the hadith although he was not accepted by some great men like Allamah Hilli.

In this narration the discrepancy concerning money and wealth has been expounded in another narration that a man complained while the accused person accepted the accusation; the complainant believed that a young man without his permission has enters his garden and destroyed the trees of his grapes; the young man accepted the complaint. Prophet Da'ud (Peace be upon him) judged base on reality in favour of the young man and collected the entire garden from the complainant to the young man….[2]

In another narration, it was clearly stated that Prophet Da'ud one time made judgment base on reality and not base on witness and the discrepancy was concerning the ownership of a cow meanwhile each an every one of them established its ownership with witness…..[3]
